SetFire Foundation, Inc. (hereinafter referred to as "we", "us", or "our") operates the Sparks Mentorship Program, connecting undergraduate students attending US colleges with experienced professional mentors. Students of all majors are welcome. SetFire Foundation, Inc. is a North Carolina nonprofit public charity and a 501(c)(3) tax-exempt public charity. Our services include mentorship matching, program coordination, and related support services (hereinafter referred to as the "Services").
By using our Services, you (hereinafter referred to as "you", "your", or "the Client") agree to be bound by this Terms of Service Agreement (hereinafter referred to as the "Agreement"), which governs the relationship between you and us, and sets forth the terms and conditions under which we provide our Services to you.
Please read this Agreement carefully before using our Services. If you do not agree with any part of this Agreement, you must not use our Services.
Eligibility and Registration
  • To participate in the Sparks Mentorship Program, you must be at least 18 years old and have the legal capacity to enter into a binding contract.
  • All participants must complete and sign a waiver as a requirement for participation in the program.
  • The Sparks Mentorship Program is a 12-month virtual mentorship program conducted entirely online.
  • You must register on our website and provide accurate and complete information about yourself, such as your name, email address, phone number, and application details.
  • You are responsible for maintaining the security and confidentiality of your account and password, and for any activity that occurs under your account.
  • You must notify us immediately of any unauthorized access or use of your account or any breach of security.
  • You must not share your account or password with anyone else or use anyone else's account or password without their permission.
  • You must not create more than one account, or use our Services for any fraudulent, illegal, or unauthorized purpose.
  • We reserve the right to suspend or terminate your account and access to our Services at any time, for any reason, without notice or liability.
Application Fees
  • SetFire Foundation mentorship services are provided at no cost to participants.
  • We reserve the right to charge a nominal application fee from time to time to cover administrative costs of processing applications.
  • If an application fee is required, it will be clearly disclosed during the application process before any payment is collected.
  • Application fees, if charged, are non-refundable once your application is submitted, regardless of acceptance status.
  • Application fees are separate from mentorship services, which remain free of charge to accepted participants.
Services and Delivery
  • We provide our Services with reasonable care and skill, in accordance with the best practices and standards.
  • We do not guarantee that our Services will meet your expectations, needs, or requirements, or that they will produce any specific results or outcomes.
  • We do not provide any medical, psychological, legal, financial, or other professional advice or services. Our Services are for educational and informational purposes only, and are not a substitute for professional guidance or treatment.
  • You are solely responsible for your own decisions, actions, and results, and for applying the knowledge and skills that you learn from our Services to your own situation.
  • You must communicate with us in a respectful and courteous manner, and refrain from any abusive, offensive, or inappropriate behavior.
  • You must provide us with any information or materials that we may reasonably request or require in order to provide our Services to you.
  • You must respect our intellectual property rights and not copy, reproduce, distribute, modify, or use any of our content, materials, or trademarks without our prior written consent.
  • We will deliver our Services to you according to the schedule and format that we agree upon with you, or that are specified on our website.
  • We will use reasonable efforts to meet the delivery deadlines, but we are not liable for any delays or failures that are caused by factors beyond our control, such as technical issues, internet problems, or force majeure events.
  • We reserve the right to modify, suspend, or discontinue any of our Services at any time, for any reason, without notice or liability.
Cancellation and Termination
  • If an application fee has been charged, it is non-refundable once your application is submitted.
  • We reserve the right to terminate this Agreement and your access to our Services at any time, for any reason, without notice or liability.
  • If we terminate this Agreement, you will lose access to the mentorship program.
  • If this Agreement is terminated, the following sections will survive: Application Fees, Services and Delivery, Cancellation and Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law and Jurisdiction, and General Provisions.
Disclaimer of Warranties
  • Our services are provided "as is" and "as available", without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy.
  • We do not warrant that our services will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
  • We do not warrant that our services will meet your expectations, needs, or requirements, or that they will produce any specific results or outcomes.
  • We do not warrant that the information, content, or materials that we provide through our services are complete, correct, reliable, or current.
  • You acknowledge and agree that your use of our services is at your own risk and discretion, and that you are solely responsible for any damages or losses that may result from your use of our services.
Limitation of Liability
  • To the maximum extent permitted by law, we and our affiliates, partners, officers, directors, employees, contractors, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, revenue, goodwill, use, data, or other intangible losses, arising out of or in connection with this agreement or your use of our services, even if we have been advised of the possibility of such damages.
  • In no event shall our total liability to you for all claims, damages, losses, and causes of action exceed one hundred US dollars ($100).
  • Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above exclusions and limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by the applicable law.
Indemnification
You agree to indemnify, defend, and hold harmless us and our affiliates, partners, officers, directors, employees, contractors, agents, and licensors from and against any and all claims, demands, actions, suits, proceedings, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with your breach of this Agreement, your violation of any law or regulation, or your infringement or misappropriation of any third-party rights.
Governing Law and Jurisdiction
  • This Agreement shall be governed by and construed in accordance with the laws of the state of North Carolina, without regard to its conflict of laws principles.
  • You agree to submit to the exclusive jurisdiction and venue of the state and federal courts located in Mecklenburg, North Carolina, for any dispute arising out of or relating to this Agreement or your use of our Services.
  • You waive any objection to the jurisdiction and venue of such courts, and any claim that such courts are inconvenient or improper forums.
General Provisions
  • This Agreement constitutes the entire agreement between you and us regarding the subject matter hereof, and supersedes any prior or contemporaneous agreements, understandings, or communications, whether written or oral, between you and us.
  • This Agreement may not be modified or amended by you, except by a written instrument signed by both you and us.
  • We may modify or amend this Agreement at any time, by posting the updated version on our website or by notifying you by email or other means. Your continued use of our Services after such modification or amendment shall constitute your acceptance of the revised Agreement.
  • If any provision of this Agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from this Agreement and the remaining provisions shall remain in full force and effect.
  • Our failure or delay to exercise or enforce any right or remedy under this Agreement shall not constitute a waiver of such right or remedy, or of any other right or remedy that we may have under this Agreement or under the law.
  • You may not assign or transfer this Agreement or any of your rights or obligations hereunder, without our prior written consent. We may assign or transfer this Agreement or any of our rights or obligations hereunder, without your consent, to any of our affiliates, successors, or assigns.
  • This Agreement shall be binding upon and inure to the benefit of the parties and their respective heirs, legal representatives, successors, and assigns.
  • This Agreement does not create any partnership, joint venture, agency, employment, or fiduciary relationship between you and us, or any rights or benefits for any third parties, except as expressly provided herein.
  • Any notice or communication required or permitted under this Agreement shall be in writing and shall be delivered by email, or by registered or certified mail, postage prepaid, to the address that each party has provided to the other party.
  • Any notice or communication shall be deemed to have been given and received on the date of delivery, if delivered by email, or on the date of receipt or refusal, if delivered by mail.
  • The headings and captions in this Agreement are for convenience and reference only, and shall not affect the meaning or interpretation of this Agreement.

Privacy Policy

Introduction
SetFire Foundation, Inc. ("SetFire," "we," "us," or "our") respects the privacy of our users ("user" or "you"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website www.setfirefoundation.org, including any other media form, media channel, mobile website, or mobile application related or connected thereto (collectively, the "Site"), and when you participate in the Sparks Mentorship Program. Please read this privacy policy carefully. If you do not agree with the terms of this privacy policy, please do not access the site or use our services.
Information Collected Through Our Website
Personal Data
We may collect personally identifiable information, such as your name, shipping address, email address, and telephone number, and demographic information, such as your age, gender, hometown, and interests, that you voluntarily give to us when you register with the Site or when you choose to participate in various activities related to the Site.
Derivative Data
Information our servers automatically collect when you access the Site, such as your IP address, your browser type, your operating system, your access times, and the pages you have viewed directly before and after accessing the Site.
Information Collected During Mentorship Program
In the course of providing mentorship services, we may collect personal information that you voluntarily provide. This may include, but is not limited to, educational background, career goals, professional information, academic challenges, and other information shared during the mentorship program and application process.
Our Use of Artificial Intelligence
We use artificial intelligence in several parts of the program. In every case the processing is carried out by Anthropic's Claude, and in every case a person makes the decisions that affect you.
Mentor matching
Your application, background, and stated goals are analyzed alongside mentor profiles to produce ranked recommendations. These are recommendations only. Every match is reviewed and decided by a person at the program office, never by software.
Mentorship guidance
Information about your mentorship, including meeting history and session notes, is used to generate guidance and suggestions for your mentor.
Waiting room assistant
If you use our in-platform assistant while waiting to be matched, your messages are processed to generate replies.
Session notes
If you agree to transcription during a video session, the transcript is used to write that session's notes. This is described in full in the next section.
What we do not send
We do not send your contact information — your email address, phone number, or home address — to any AI provider. Mentor matching is performed on goals, interests, and background only; mentors are identified to the system as "Mentor A" and "Mentor B" rather than by name. Where first names do appear, it is because they were spoken in a session you agreed to have transcribed.
What we do not do
We do not use your information to train artificial intelligence models. We do not use AI to make decisions about your acceptance into the program, your match, or your continued participation. Those decisions are made by people.
Video Sessions, Recording, and Transcription
We never record your sessions.
No audio or video of a mentoring session is captured, stored, or retained at any point. Recording is not a feature of our platform.
Transcription is optional and requires both people to agree
Sessions held on Video Call, our in-platform video service, can be transcribed only if both the mentor and the student switch transcription on during that call. The mentor turns it on first, and the student's switch stays locked until they do. Either person can switch it off at any moment, and transcription stops immediately. Agreement covers that one session only and is never remembered or carried into a later call. Nothing is transcribed unless both switches are on at the same time.
What transcription produces
The conversation is converted to text as it happens, and after the call an AI writes structured session notes from it, covering topics discussed, key takeaways, action items, resources mentioned, and questions to reflect on. Those notes become the shared notes for that meeting and can be read by both the mentor and the student. The mentor can remove them at any time.
The transcript is deleted
Once the notes are written, the transcript is deleted. It is never stored in our database at any point. It exists only with our video provider, and only until the notes are produced. A separate automated process deletes any transcript older than seven days regardless of whether notes were ever written.
Who handles the words
The video call and its transcription run through Daily, which uses Deepgram for speech-to-text, and the session notes are written by Anthropic's Claude. SetFire retains no audio and no transcript, and does not use session content to train artificial intelligence models or for any purpose beyond producing that session's notes.
Sessions held elsewhere
This applies only to sessions held on Video Call. If your mentor hosts the session on their own Zoom, Microsoft Teams, or Google Meet link, that session takes place outside our platform and is neither transcribed nor accessible to us.
Use of Your Information
Having accurate information about you permits us to provide you with a smooth, efficient, and customized experience. Specifically, we may use information collected about you to:
  • Create and manage your account.
  • Process your mentorship application and match you with appropriate mentors or mentees.
  • Communicate with you regarding your account, application status, or mentorship activities.
  • Provide personalized mentorship services and program coordination.
  • Fulfill and manage any transactions related to the Site or Services.
  • Increase the efficiency and operation of the Site and our mentorship program.
  • Monitor and analyze usage and trends to improve your experience.
Confidentiality of Mentorship Information
We are committed to maintaining the confidentiality of all information shared during mentorship sessions and throughout the program. Our mentors and staff are bound by confidentiality agreements and ethical standards to ensure that your personal information is protected and respected. Information shared during mentorship sessions will be used solely for the purpose of providing mentorship services and will not be used for marketing purposes or shared with third parties without your explicit consent, except as required by law.
Disclosure of Your Information
We may share information we have collected about you in certain situations. Your information may be disclosed as follows:
Affiliate Organizations and Workplace Partners
If you are a member of an affiliate professional organization (such as IMA, SHRM, etc.), we may share your name and member number with that organization for program tracking and impact reporting purposes. If you are an employee or retiree of a workplace partner organization, we may share your name and retirement status with that organization for the same purposes. No other personal information is shared with these organizations without your explicit consent.
By Law or to Protect Rights
If we believe the release of information about you is necessary to respond to legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property, and safety of others, we may share your information as permitted or required by any applicable law, rule, or regulation.
Third-Party Service Providers
We may share your information with third parties that perform services for us or on our behalf, including website and data hosting, email and text message delivery, payment processing, video calling and transcription, artificial intelligence processing, data analysis, customer service, and marketing assistance. These providers may only use your information to perform those services for us.
Security of Your Information
We use administrative, technical, and physical security measures to help protect your personal information. This includes secure storage of physical and electronic records and implementing confidentiality agreements with staff and contractors. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse.
Your Rights
You have the right to access and control your personal information. This includes:
  • The right to request access to the personal information we hold about you.
  • The right to request that inaccurate information be corrected.
  • The right to ask for your information to be deleted from our records.
  • The ability to review or change the information in your account at any time by logging into your account settings and updating your account.
  • The ability to terminate your account by contacting us using the contact information provided.
